Please read these Terms of Use carefully before using the CueMedTM application and any related websites provided by CuePath™ (collectively, the “Site”) and print a copy for your records. These Terms apply to all activities of CuePath™, unless a separate Terms document is provided for a particular product, service or activity.
By accessing or using the Site or the CueMedTM application, the User (“you”) agree to be bound by these Terms of Use and all applicable laws. If you do not agree, do not access or use the Site or the CueMed™ application.
CuePath™ may modify these Terms at any time, effective immediately upon posting. Continued use after modifications constitutes acceptance of the revised Terms.
Availability
The services and functionalities provided on the Site or through CueMedTM are for your convenience and may be modified or removed at any time.
Reliance on Information
Information, software, images, logos, trade-marks, functionalities, and products provided on or through the Site or CueMedTM may include inaccuracies or errors, which CuePath™ may correct at its discretion.

Intellectual Property
All materials on the Site or within CueMed, including software, design, text, images, logos, trade-marks, and other content (“CuePath™ Materials”), are owned by CuePath™ or its licensors and protected by copyright and other intellectual property laws.
CuePath™ grants you a personal, non-exclusive, non-transferable license to use CuePath™ Materials for personal, non-commercial purposes only, provided all copyright and proprietary notices are maintained. You may not modify, distribute, reproduce, create derivative works, or display Materials without prior written permission.
Device Connectivity
CueMedTM connects to CuePack™ Bluetooth-enabled (BLE) stickers that are applied by pharmacists to commonly-avaiable blister packs to create an electronic medication adherence solution. Proper functionality and accuracy depend on:
- The type of blister pack used
- Storage condition of the blister packs
- Patient and pharmacy Bluetooth availability and connection quality
- Battery levels of both the blister packs and the iPhone
- Environmental conditions and patient pack handling
- Hardware and performance of the iPhone being used
CuePack™-enabled blister packs are designed to operate without harm; however, accuracy may be affected if they are mishandled, damaged, or used improperly. While CueMed is optimized for accurate performance, results may vary depending on user behavior, blister pack condition, and iPhone hardware and performance.
Disclaimer of Warranties
THE SITE, CUEMED™ APPLICATION, CONTENTS, AND ANY SOFTWARE, PRODUCTS, FUNCTIONALITIES, OR SERVICES OFFERED HEREIN ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CUEPATH™ MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability
To the maximum extent permitted by law, CuePath™ and its products shall not be liable for:
- Missed medications
- Incorrect medication usage
- Any health-related outcomes
- Loss of data
- Device connectivity failures
In addition, CuePath™ and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages, including loss of property or goodwill, arising from the use or inability to use the Site or the CueMed™ application, even if advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold harmless CuePath™ and its affiliates from any claims, liabilities, damages, or expenses, including legal fees, arising from your use of the Site or CueMed™ application or violation of these Terms of Use.
Termination
CuePath™ may restrict or terminate your access to the Site or CueMed™application at any time, with or without notice, for any reason, including violation of these Terms or conduct harmful to CuePath™ or other users.
Governing Law
These Terms shall be governed by and construed under the laws of the Province of British Columbia, Canada. Parties irrevocably submit to the jurisdiction of its courts.
General
These Terms constitute the entire agreement between you and CuePath™ regarding your use of the Site and CueMed™ application. If any provision is invalid or unenforceable, the remainder shall remain in effect. These Terms and all related documents are drawn up in English.
